Comments on reproduction treatments for lesbian couples

Single lesbians and lesbian couples are constantly visiting our centre to become pregnant. In accordance with Law 14/2006, governing assisted human reproduction techniques, women may use these processes regardless of marital status and sexual orientation, so any single woman can undergo an assisted reproduction treatment with donated sperm, providing an informed consent form is signed and all rights and obligations with regard to the baby are upheld. In the case of couples (married or not), consent has to be signed by both people and the rights and obligations with the regard to the baby apply to them both.

 In the case of women whose ova are not suitable for pregnancy, single women may opt for anonymous egg donation and women in a relationship (married or not) may receive the ova from their partner. In the first case, two informed consent forms are required, one from the semen donor and the other from the ova donor. In the second case, only a sperm donor document needs to be signed and both women would have maternal authority over the baby.

The aim of these comments is not to create jurisprudence but to raise awareness regarding the new social situation of this group of patients.
